These Terms of Service (“Terms”) govern your use of Tmatch, a service provided by Tmind AI (“Tmatch,” “we,” “us,” or “our”). By accessing or using Tmatch, you agree to these Terms.

1. Nature of the Service

Tmatch is a technology platform that connects individuals with independent, licensed mental health therapists.

  • Tmatch does not provide medical advice, diagnosis, or therapy
  • Therapists on Tmatch are independent providers, not employees, agents, or contractors of Tmatch or Tmind AI
  • Any therapeutic relationship exists solely between you and the therapist
  • Therapist Verification: Tmatch may perform limited verification of a therapist’s professional licensure. This verification is based on information provided by the therapist and publicly available state records at the time of intake. Tmatch does not guarantee the ongoing validity of any license, the therapist’s clinical competency, or the quality of care provided. Users are encouraged to independently verify a therapist’s credentials through their respective state licensing boards.
  • When Tmatch handles Protected Health Information on behalf of therapists, it does so in accordance with applicable HIPAA requirements and contractual obligations.

2. The Role of AI (Tracy)

You acknowledge and agree that Tracy is an Artificial Intelligence (AI) Case Manager, not a human.

Tracy:

  • Guides you through intake questions
  • Organizes and summarizes information you provide
  • Supports therapist matching

Tracy:

  • Does not provide clinical judgment
  • Does not diagnose or treat any condition
  • Does not replace a licensed therapist
  • Is not capable of crisis detection or intervention

AI-generated summaries are informational only and may be incomplete or inaccurate. You and your therapist are responsible for verifying all information.

3. Emergency Disclaimer

Tmatch and Tracy are not designed for emergency use.

If you are experiencing a mental health emergency or are in immediate danger:

  • Call 911, or
  • Call or text 988, the Suicide & Crisis Lifeline (U.S.)

Do not rely on Tmatch or Tracy for crisis support.

4. User Responsibilities

You agree to:

  • Provide accurate, current, and complete information during intake
  • Understand that matching quality depends on the information you provide
  • Maintain the confidentiality of your account credentials
  • Accept responsibility for all activity conducted under your account

5. Limitation of Liability

To the fullest extent permitted by law:

  • Tmind AI and Tmatch are not liable for any damages arising from:
    • Your use of the platform
    • AI-generated summaries or recommendations
    • Any reliance on “Verified” badges or licensure documents displayed on the platform
    • The professional services, conduct, or outcomes provided by therapists
    • Tmatch acts as a payment facilitator. While we handle the transaction, Tmatch is not responsible for disputes regarding the clinical quality of the session or refunds once funds have been distributed to the therapist.

Tmatch does not guarantee therapist availability, outcomes, or suitability.

6. Modifications to the Service

We reserve the right to:

  • Update or modify Tracy’s functionality
  • Add, change, or remove features
  • Suspend or discontinue parts of the service

We may update these Terms from time to time. Continued use of Tmatch constitutes acceptance of updated Terms.

7. Governing Law

  • These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.
